Comitia Terms of Service
Article 1 Purpose
These Terms govern the rights and obligations between Comitia and users regarding the use of the digital comic creation and related services provided by Comitia.
Article 2 Definitions
- User: any person who uses the Service.
- Member: a user who has created an account.
- Content: any material entered, uploaded, created, published, or stored by users.
- Generated Output: content generated through AI features.
- Advertisement: any advertising or sponsored content displayed through the Service.
- Advertising Partner: a third-party service provider, including Google AdSense, that may provide, measure, or support advertisements within the Service.
Article 3 Changes to Terms
Comitia may modify these Terms when necessary. Important changes will be announced before they take effect.
Article 4 Account Management
Users must provide accurate information and are responsible for maintaining the security of their accounts. Users may delete their accounts at any time.
Comitia may restrict or suspend accounts in the following cases.
- Violation of these Terms or policies
- Creation or publication of illegal or policy-violating content
- Abuse of service systems
- Security threats
- Advertising abuse, invalid traffic, or manipulation of advertisements
Comitia may restrict account access without prior notice if necessary, and users may submit an appeal.
Article 5 Service Provision
Comitia may provide the following features.
- Comic creation tools
- Character creation tools
- Content storage and sharing features
- Subscription services
- Advertising-supported content or features
Comitia may modify or discontinue parts of the Service.
Article 6 Paid Services
Paid service fees will be displayed within the Service. Subscriptions may automatically renew. Cancellation and refund policies will follow applicable policies or legal requirements.
Article 7 Advertisements
Comitia may display advertisements within the Service, including advertisements provided by Google AdSense or other advertising partners.
Advertisements displayed within the Service do not constitute endorsement, recommendation, or guarantee by Comitia.
Users must not manipulate advertisements, advertising impressions, or advertising clicks. Prohibited conduct includes, but is not limited to:
- Clicking advertisements for artificial or fraudulent purposes
- Encouraging other users to click advertisements
- Using bots, scripts, automated tools, repeated manual actions, or other methods to generate artificial ad impressions or clicks
- Placing, publishing, or promoting content intended primarily to manipulate advertising revenue
- Interfering with advertisement display, measurement, or fraud-prevention systems
Comitia may restrict content, disable monetization, suspend accounts, or take other necessary action if a user violates advertising-related policies or applicable advertising partner requirements.
Article 8 Prohibited Conduct
Users must not engage in the following activities.
- Creating, publishing, or distributing illegal content
- Creating child exploitation content or sexualized depictions of minors
- Promoting hatred, violence, terrorism, or violent extremism
- Harassing, threatening, or abusing others
- Violating copyrights, trademarks, publicity rights, privacy rights, or other rights of others
- Creating non-consensual sexual content, sexual deepfakes, or deceptive impersonations
- Publishing misinformation, scams, phishing content, or intentionally deceptive content
- Exploiting service security vulnerabilities
- Sending excessive automated requests or using bots to abuse the Service
- Attempting to bypass content moderation, safety filters, rate limits, or monetization restrictions
Article 9 Content and Intellectual Property
Copyright of content created by users belongs to the users by default, unless otherwise agreed or required by law.
Users grant Comitia a non-exclusive license to use such content as necessary for operating, displaying, distributing, improving, protecting, and promoting the Service. This license is limited to the purposes reasonably necessary for the Service and does not transfer ownership to Comitia.
Users are responsible for ensuring that they have the necessary rights to publish, share, or commercialize their content.
Article 10 Generative Features and AI Content Review
AI-generated content may have the following characteristics.
- Errors
- Similarity to existing content
- Unexpected results
- Inconsistent or incomplete outputs
Since AI systems operate based on statistical models, generated outputs may resemble existing content. Users are responsible for reviewing content before publishing it.
Comitia may apply automated or manual review, safety filters, content restrictions, or removal actions to prevent illegal, harmful, infringing, deceptive, or policy-violating AI-generated content from being published or monetized.
Article 11 Content Commercialization
Content commercialization may occur through creator programs, platform IP programs, advertising, sponsorship, or separate agreements. Unless otherwise agreed, copyright remains with the creator.
If commercialization occurs, the scope of rights, revenue sharing, license scope, duration, territory, ad eligibility, and other monetization conditions may be defined through separate agreements or applicable policies.
Article 12 Copyright Infringement Reports (DMCA)
Copyright infringement reports must include the location of the allegedly infringing content, a description of the claim, and contact information. Comitia may restrict or remove content after reviewing a report.
Comitia may adopt and enforce a repeat infringer policy and may terminate accounts that repeatedly infringe intellectual property rights.
Article 13 Enforcement and Appeals
If a user violates these Terms or related policies, Comitia may remove content, restrict visibility, disable monetization, issue warnings, suspend accounts, terminate accounts, or take other measures reasonably necessary to protect the Service and its users.
Users may submit an appeal through customer support channels. Comitia will review appeals within a reasonable period.
Article 14 Limitation of Liability
Comitia is not liable for damages resulting from user fault, force majeure, use of free services, third-party services, advertising partner actions, or content generated, uploaded, or published by users, except where prohibited by law.
Total liability shall not exceed the amount paid by the user in the previous three months, except where a different standard is required by applicable law.
Article 15 Governing Law
These Terms are governed by the laws of the State of Connecticut, United States.
Article 16 Dispute Resolution
Disputes shall first be resolved through mutual negotiation. If negotiation fails, the courts of Connecticut shall have exclusive jurisdiction, unless applicable law requires otherwise.
